ON THE PROBLEM OF UNAUTHORIZED DUMPS

Annotation. In the report, the problematic issues connected with legal regulation of activity on liquidation of unauthorized dumps are considered. The author singles out such problems as the imperfection of the conceptual base of the accumulated harm to the environment, and the presence of contradictions in the current legislation with regard to the definition of the authorized body and its powers. The need to specify the criteria for determining the objects of accumulated harm, to distinguish between the powers of state and local authorities on their liquidation is justified. Considering the question of law enforcement practice related to liquidation of unauthorized dumps, the author proves the necessity of generalization of the judicial practice by the Supreme Court of the Russian Federation.
