Handling solid municipal waste: legal problems of providing public services in non-residential premises of an apartment building

 

Annotation. Legal issues of contractual relations between regional operators and consumers of their services in apartment buildings require their solution. The article examines certain problematic aspects of the legal regulation of contractual relations for the provision of services for the treatment of municipal solid waste in non-residential premises of an apartment building and their resolution in the law enforcement practice of arbitration courts. The author touches upon the issues of determining the consumer of the service, the obligation / optionality of concluding an agreement for the owner of non-residential premises, commercial accounting of municipal solid waste, etc. In addition, the author draws conclusions and recommendations for improving the legal regulation of the provision of services for the treatment of solid municipal waste in non-residential premises of an apartment building.
